CUSTOMER SERVICE POLICY: Robin Baron Collections takes great pride in guaranteeing customer satisfaction. If you have any questions, comments, or concerns, simply call us at 212-262-1110.
PRICE LIST: Prices are subject to change without notice.
ORDERING: All orders will be acknowledged via email as soon as possible after placed.
PRODUCT CUSTOMIZATIONS: We pride ourselves on providing as much flexibility and customization to our product as possible. Many of our SKUs can be customized for an additional charge. Please inquire for pricing on any custom orders.
PRODUCT SAMPLES: Color, texture, and finish samples are available for some products. These samples are intended for reference only and should not be used for exact color or scaling.
CHARACTERISTICS OF HANDMADE PRODUCTS: Many Robin Baron Collection products are handmade. Slight variations in color, texture and finish are normal.
- Each item is handcrafted and the following should not be considered defects:
- Loose slubs of yarn or fabric: This can occur when a yarn color is changed, a new length of yarn is inserted, or at a seam. Please do not pull the yarn or fabric. Simply cut it with scissors to be even with the surface.
- Variations in color: Yarns and fabrics are often hand dyed. Exact color matching is not always possible, subtle shade changes within the same color family is considered acceptable and is to be expected.
- Case goods are handcrafted, hand painted, and hand stained and each unique product might display slight variations of color and texture.
- Hardware is hand finished and slight variations in the finishes are part of the nature of these artisanal pieces.
- Colors of the product do not match the photographs: Despite our best efforts, photography and ink, especially printed on paper, do not reflect reality 100%. In addition, dye lots vary slightly between production runs of the same style. When needing two products of the same dye lot, please specify on your order form.
- Odor: Wools, dyes, silks, artificial silks, backing materials and cleaning agents all have inherent moisture and occasionally environmental conditions disallow adequate “airing” prior to packing and shipping of rugs. If you experience odor in a rug, please lay the rug flat over a rug pad where adequate air circulation can dissipate any odor. Odors may be present in hand painted and hand stained furniture upon receipt. Please allow adequate air circulation for these products as well so the odor can dissipate. Should the odor persist more than two weeks, please contact us.
PAYMENT AND TERMS: Orders will be processed and finalized after the required deposit, or payment, is received. YOUR DEPOSIT/PAYMENT IS YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF OUR TERMS AND CONDITIONS. We accept most major credit cards. A 3% service fee will be added to any orders that are paid by credit card. Payments must be paid in full, including any additional freight or delivery, before any item is shipped, or released off a showroom floor. Once the final request for a balance due is issued, customer has no more than 30 days to pay before it is considered past due. A 1.5% charge is added for each month an account is past due.
LEAD TIME: All orders are manufactured on demand, upon payment and order acknowledgment. We are not responsible for fluctuations in lead times due to circumstances beyond our control. Lead times do not include shipping time. Typical lead times are as follows and are subject to change without notice. Lead times begin after receipt of deposit/payment and all approvals, including finish options and shop drawings, if necessary. For upholstery, receipt of fabric in our workroom is necessary for production to begin and therefore also effects lead time.
Rugs: 2-5 months
Case goods: 10-12 weeks for standard offerings and 12-14 weeks for customized orders
Fabric: if in stock: 2 weeks
Hardware: if in stock: 2 weeks
Lighting: 8-10 weeks
Tables: 10-12 weeks for standard offerings and 12-14 weeks for customized orders
Upholstery: 10-12 weeks from receipt of fabric
ORDER CHANGES AND CANCELLED ORDERS: Robin Baron Collections does not accept changes or cancellations of confirmed orders. Because we do not accept cancellations, on orders that require a 50% deposit, the balance will still be due. YOUR DEPOSIT/PAYMENT IS YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THIS CANCELLATION POLICY. Any changes to a confirmed order will incur additional charges.
RETURNS: Robin Baron Collections does not accept returns and all sales off the floor are final sales.
SHIPPING: Robin Baron Collections will use its judgment to choose both carrier and route unless specific instructions are provided at the time order is placed. Robin Baron Collections attempts to comply with reasonable special instructions and delivery requests as long as they do not conflict with Robin Baron Collections Terms and Conditions.
FREIGHT CHARGES: All freight charges from Robin Baron Collections designated warehouse to customer are billed to the customer and must be paid prior to shipping. Robin Baron Collections is happy to consider customer requests and specifications as long as they are in keeping with Robin Baron Design Inc. Collections requirements and policy to ensure safe and damage-free shipping. Any special freight charges incurred during delivery by the carrier for storage, residential delivery, interline service, lift back trucks, and/or driver assistance will be billed separately to the customer. Customers may supply their own freight carrier and have charges billed directly to them, without any Robin Baron Collections involvement, however a 5% packaging and handling charge will be added to the invoice. Freight prices apply to the continental USA only. Freight and export charges for outside the continental United States require advanced quoting.
DAMAGES AND FREIGHT CLAIM PROCEDURES: While damages are a rare occurrence, please inspect your shipment thoroughly upon arrival. Please note any damages/shortages on the bill of lading before you sign for receipt of the shipment.
All delivered items must be unwrapped and inspected upon arrival, whether to a warehouse or if it is an in-home delivery. In the unlikely event that an item appears to be damaged in transit, please contact us at 212-262-1110 immediately, while the driver is still present, to determine the next steps. UNLESS ALL ITEMS ARE INSPECTED UPON RECEIPT, ANY ISSUES ARE NOTED ON THE FREIGHT RECEIPT, AND WE ARE CONTACTED RIGHT AWAY, WE MAY NOT BE ABLE TO ASSIST YOU IN THE REPAIR, REPLACEMENT, OR RETURN OF A PRODUCT. YOUR FAILURE TO PROVIDE US WITH PROPER NOTICE OF A CLAIM AS STATED ABOVE, SHALL CONSTITUTE A WAIVER FROM YOU OF ALL CLAIMS WITH RESPECT TO SUCH PRODUCTS. If using a Robin Baron Collections freight carrier, we will file the freight claim. If a client requests to use their preferred carrier (with their own account number), the client assumes responsibility for any and all damages that may occur during transit and for filing claims with the carrier for the damaged item(s). Any concealed or obvious damage and/or shortage must be reported to the Customer Service Department at Robin Baron Collections no later than 5 business days after customer receipt. Once reported, Robin Baron Collections will provide customers with additional instructions as to how the situation is to be rectified.
DISCLAIMER OF WARRANTIES. THE WARRANTIES SET FORTH HEREIN OR IN OUR WARRANTY DOCUMENTS WITH RESPECT TO A PRODUCT ARE THE ONLY WARRANTIES MADE BY ROBIN BARON COLLECTIONS IN CONNECTION WITH OUR PRODUCTS AND THE TRANSACTIONS CONTEMPLATED AS A RESULT OF THIS SALE. ROBIN BARON COLLECTIONS MAKE NO OTHER WARRANTIES OR REPRESENTATIONS TO YOU OR ANY OTHER PERSON OF ANY KIND, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS, AND WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. PRODUCTS SOLD HEREUNDER ARE SOLD ONLY TO THE SPECIFICATIONS SPECIFICALLY SET FORTH BY THE ROBIN BARON COLLECTIONS IN WRITING. OUR SOLE OBLIGATION FOR A REMEDY TO YOU SHALL BE REPAIR OR REPLACEMENT OF NON-CONFORMING PRODUCTS, SUBJECT TO OTHER CLAIM PROCEDURE AS STATED IN THESE TERMS OF SALE. BUYER ASSUMES ALL RISK WHATSOEVER AS TO THE RESULT OF THE USE OF PRODUCTS PURCHASED, WHETHER USED ALONE OR IN COMBINATION WITH OTHER PRODUCTS.
LIMITATION OF LIABILITY. No claim of any kind including, but not limited to, claims for indemnification, whether as to the quality or amount of product delivered or non-delivery, shall be greater in amount than the purchase price for said products in respect of which damages are claimed. IN NO EVENT SHALL WE, AT ROBIN BARON COLLECTIONS, BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, STATUTORY, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE, LOSS OF TIME, INCONVENIENCE, LOST BUSINESS OPPORTUNITIES, DAMAGE TO GOOD WILL OR REPUTATION, ARISING OUT OF, OR AS A RESULT OF, THE SALE, DELIVERY, SERVICING, USE OR LOSS OF THE PRODUCTS SOLD HEREUNDER, REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON BREACH OF CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES COULD HAVE BEEN REASONABLY FORESEEN.
EXCUSES FOR NON-PERFORMANCE. If the manufacture, transfer or receipt by either party of any products covered hereby is prevented, restricted or interfered with by reason of any event beyond the reasonable control of the party so affected, such party shall be excused from making or taking deliveries hereunder to the extent of such prevention, restriction or interference, and neither party shall be liable to the other for default or delay in performing, except with respect to Buyer’s payment obligations.
GOVERNING LAW. This Agreement shall be construed, according to the laws of the State of New York without giving effect to its principles of conflicts of laws.
